Road Traffic Accident Claims

If you have been involved in a road traffic accident, in the last three years which was not your fault, then you may be entitled to make a personal injury claim.

If you were a passenger in a car, bus or coach; which is involved in an accident then you may also be entitled to make a personal injury claim. As an injured passenger the likelihood of making a successful personal injury claim is very good as there would be little you could do to avoid the accident. Compensation for your injuries is paid by the insurance company of the person responsible for the accident. This may be the driver of the vehicle you were in or a third party driver or in some cases both.

If you have been injured whilst you were a pedestrian, a motorcyclist, a cyclist or a driver, your personal injury claim would be made against the insurance company of the person driving the other vehicle.

One of the most common types of injury is whiplash. A whiplash injury can affect the neck and back and can vary in severity. For more information on claiming compensation following a whiplash injury view our Whiplash Injury page.

Making a Personal Injury Claim

As with all personal injury claims, you will need of course to prove that another person was responsible for your personal injury. To help your personal injury solicitor, we would recommend that you gather as much information as possible about the accident including details of any witnesses, photos and insurance details etc. If the Police were called they will be able to supply you with a reference number which will also be helpful to your personal injury solicitor.

If you  intend to claim expenses such as prescription costs and travelling expenses, remember to keep your receipts.

The Motor Insurers' Bureau (MIB)

Road Accidents involving Untraced or Uninsured drivers

If you have been injured or your property has been damaged by an uninsured or untraceable driver, you may still be able to make a claim for compensation via the Motor Insurers' Bureau or MIB.

In order to make a personal injury claim through the Motor Insurers' Bureau you will need to demonstrate that you to have already tried to trace the driver or insurer concerned by reporting the accident to the police. You will also need to report the accident to your own insurance company.

Certain conditions apply to claims made via the Motor Insurers' Bureau such as:

·         If the driver of the vehicle is untraceable you must at least be able to identify the vehicle to make a claim.

·         An excess of £300 will also be deducted from claims made under the untraced driver scheme for property damage.

·         The Motor Insurers' Bureau will only deal with claims registered with them within 9 months of the accident.  They will also expect the accident to have been reported to the police within 5 days of the accident.

An individual wishing to enter a claim with the Motor Insurers' Bureau can do so directly themselves or appoint a Solicitor to work on their behalf.
